Copyright & DMCA Policy

Hau3Folio respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, we respond to clear notices of alleged copyright infringement and, in appropriate circumstances, remove infringing material and terminate the accounts of repeat infringers.

This policy explains how copyright owners can report infringing content, how affected users can respond, and how we handle repeat infringement.

2.Filing a Takedown Notice

To be effective, a notice of alleged infringement must include all of the following. Incomplete notices may not be actionable, and you may be liable for damages (including costs and attorneys’ fees) under § 512(f) if you knowingly misrepresent that material is infringing.

• Identification of the copyrighted work you claim has been infringed.
• Identification of the material that is infringing, with the exact URL(s) so we can locate it.
• Your contact information: full name, mailing address, and email.
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on its behalf.
• Your physical or electronic signature.

3.Submit a Takedown Notice

4.Counter-Notification

If your content was removed and you believe this was a mistake or misidentification, you may submit a counter-notification to our designated agent at harry.radovich@hau3folio.com. A valid counter-notification must include:

• Your physical or electronic signature.
• Identification of the material removed and the location where it appeared before removal.
• A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
• Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal court for your district (or, if outside the U.S., any district in which Hau3Folio may be found), and that you will accept service of process from the person who filed the original notice.

If we receive a valid counter-notification, we may restore the material in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

5.Repeat Infringer Policy

Hau3Folio will, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who are determined to be repeat infringers. We also reserve the right to remove content and suspend accounts at any time for violations of our Terms of Service.
